it doesn't say in the article that GEMA and Berghain have found an agreement for 2013 and beyond...

It says Berghain and GEMA have found an agreement (like many if not all other clubs in Germany) until now...

The article doesn't state anything about an agreement for 2013.

It simply says that the owners have confirmed that Berghain will stay open even if the GEMA raise their rates, but that the Kubus project has been put on hold as funding the project will no longer be affordable cos of the GEMA situation.

I wonder will they relax their fussy door policy now?

Thanks nd, We have corrected the article to reflect this and put in an update to point out what it had said previously.

Great news, would be a travesty if the place shut down

The 'fussy' door policy you speak of is very much for the good of the club. The experience inside would be a lot worse without it

agreed. they need to keep the door policy. that's what makes the place so special.

It's not a Berghain forum thread without a debate over their door policy

Clubs the size and popularity of Berghain, Watergate , Tresor etc won't close as a result of GEMA. GEMA has realised that Techno makes heaps of cash in Berlin and they want a cut. They(GEMA) have started with an outrageous bid which over time will come down to tolerable levels. Sounds like a business/tax deal getting blown out of proportion.

Berhain staying open was obliviously obvious. Even with the unfavorable new tariffs, Berghain would still make more than enough profit to continue operating and to do it at such a high level. So will the other top clubs in Berlin (and rest of Germany) like Watergate and Cocoon in Frankfurt. They will only be making a lower margin. It's the smaller venues (maybe like a Golden Gate or a Suicide Circus?) that would run into a bit of trouble.

Fantastic! Can't wait for my first Berghain visit.

Good new yes, But i think it was pretty much taken for granted that it wasn't gonna shut its door.. SMALL CLUBS will doffer about this bloody GEMA... not big clubs like Berghain.. simple!

Was told by Seanie man leonard who is studying polls in berlin that the way he hears it is the gov they just want more money simple as and they will get it one way or another ! and clubbers will just have to pay

the problem is, the money is being payed for somebody who doesnt give a shit about techno music, it wouldnt be hard to pay 1-2 euros more for ticket to get the 'fee' for the club by the clubbers, but that wouldnt be fair, because they're just taking money for nothing.. why other bussinesses can work monday to friday and dont pay those huge taxes? i really dont get it, why would someone need to pay bigger taxes for staying up longer.. i would just not give a shit and not pay, they're already lucky to get atleast something

It's because GEMA considers that the tracks played inside the clubs are played without the permission of the DJ / producers who composed it.
The longer you're open, the more tracks are played so you have to pay more.
Mathematically, it is a 'logic" point of view... for them I meen... Of course I dont defend them.
They have to understand the electronic music and the concept of a dj for sure... when ben is playing a track inside berghain from an not-so-famous producer, I am not sure that the producer will feel stolen of offensed :) It's more a kind of mediatisation.
And like already said, this same hypotetical producer will not get money from GEMA at the end !! so total nonsense indeed.
